As data volumes continue to grow exponentially and regulation becomes increasingly complex, law firms consistently place the management and security of their data – including data privacy, regulation and compliance issues--as the number one issue facing their businesses.  As firms have been sluggish in response, clients have become more likely than ever to include strict stipulations in Outside Counsel Guidelines (OCG) regarding how they want their data to be stored, accessed, and disposed of including the ability to audit what measures their outside counsel has committed to support.

Mattern’s IGP consultants developed the 2023 Mattern Information Governance Survey in response to the lack of insights firms possess, industry-wide, regarding retention policies.  Data retention, email in particular, is one of the most contested areas of IG, and firms by and large have very little to no visibility into the practices of their peer firms.  This potent combination often results in the pivotal stall-point for many firms to implement policies that are in their firms’ best business interests as well as their clients, in particular as it relates to compliance with OCGs.
