Litigation teams face challenges that are growing in scope and intensity. The number of cases is increasing, and each case is becoming more complex. In addition, data volumes continue to rise, and clients expect faster insights and more transparency. Many litigation support teams have adopted AI-enhanced case management and preparation software to accelerate administrative tasks and optimize workflows. However, until recently, advanced tools designed for litigators to enhance case strategy have been limited.
According to a new report from Ari Kaplan Advisors, this gap has given rise to a category of technology: case strategy software. The research and analysis, based on partner and senior lawyer perspectives, reveal an opportunity. Law firms that adopt AI-enhanced case strategy solutions early will gain a significant competitive advantage.
Validating the case strategy software category
Case strategy software represents an evolution in how litigation teams approach complex disputes. It enables teams to connect insights, evidence, chronologies, and narrative development within a single, AI-enhanced environment.
Ari Kaplan Advisors’ research validates this emerging category and confirms the challenges facing litigation leaders. While most of their teams have adopted case management software to centralize data and improve collaboration, most senior lawyers don’t use technology to drive deeper analysis and strategy development.
Conducted between July and August 2025, the study includes interviews with 31 attorneys, most of whom are partners at large law and enterprise firms. The findings show that 87 percent of participants believe AI-enhanced case strategy technology provides a competitive advantage. This underscores that the next wave of litigation innovation will focus on how litigators use AI to strengthen their approach to building persuasive, winning case narratives.
Partners are embracing AI and rethinking their approach to case strategy
Despite senior lawyers being historically resistant to change, the increasing rate of AI adoption tells a different story. Among the interviewees, 84 percent reported adopting AI tools in the past year, and 61 percent are already using them routinely to assist their day-to-day work.
These findings reflect a fundamental shift. Partners who previously relied upon their teams to use new technology, now view direct engagement with AI as essential to maintaining their competitive edge. Still, there’s more room for growth as 74 percent of respondents in the study said they want to spend more time focusing on theory and evidentiary goals rather than on administrative tasks. In addition, 90 percent agreed that faster access to insights offers an advantage.
This data reflects the current challenges facing litigators as well as their growing recognition of the value that AI offers by enhancing, rather than replacing, their expertise. The participants shared how they’re currently using AI and new opportunities for AI to deliver value in case strategy:
Bringing case strategy software into a unified litigation tech stack
In many firms, eDiscovery and case management software form the backbone of their litigation tech stack. However, adoption by senior lawyers is generally low. After all, the capabilities and design of these solutions typically don’t fully meet litigators’ needs, focusing on various aspects of information management rather than developing winning case strategies and improving client relationships.
Partners and trial lawyers want tools to work together seamlessly with the systems their teams already use, eliminating silos and accelerating collaboration. So, by unifying AI-enhanced case strategy software with established case management, analysis, and preparation tools, firms can create a truly connected litigation technology ecosystem. This enables every member of the team to contribute to a comprehensive and cohesive strategy.
This unified, best-practice approach also benefits clients. Faster insights, stronger case narratives, and more transparent collaboration translate directly into greater value and trust, which will be key differentiators in an increasingly competitive market.
What comes next for law firms
The findings in the report also reveal a growing sense of urgency. As one participant noted, “Eventually, AI-enhanced case strategy tools will become the price of admission.” For many firms, that moment is already a reality.
Leaders who embrace these tools now are gaining a clear advantage: they’re streamlining preparation, improving responsiveness, and building better stories. They’re also positioning themselves as trusted advisors to increasingly tech-savvy clients who expect their counsel to be fluent in AI-driven solutions.
For firms still evaluating their options, the message is clear: the evolution of the litigation tech stack is underway. The opportunity lies in how quickly and effectively teams can align their technology, processes, and strategy to meet the demands of modern litigation.
